DELIVERY, FREIGHT

Regardless of the destination of the equipment and the terms of the sale, delivery is considered complete once the equipment is taken over by the carrier from our factory or from the factories of our suppliers. The risks and responsibility for the equipment are therefore transferred at the moment of pickup, even in the case of free delivery. The equipment is insured only upon explicit instructions and at the buyer’s expense (Insurance will be taken out with the carrier for shipment based on the total invoice value). It is the buyer’s responsibility to carry out all necessary checks, make any reservations upon the arrival of the equipment, and, if necessary, exercise any recourse against the carrier within the legally required timeframe, generally within 24 hours.
If you choose a shipment without insurance and the package is lost, COMITRONIC-BTI will not reimburse the goods. The loss of the package will be at your expense.
For self-arranged transport: If you choose to collect your parcels yourself, we will send you an email notifying you when your parcel is ready. You then have 72 business hours (Monday to Thursday) to arrange for your transporter to pick up the parcel. After this period, a storage fee of €100 per full day (Monday to Sunday) will be applied.

We only use two possible Incoterms :
EXW – COMITRONIC-BTI Factory, Canéjan (France): when the customer arranges and covers all transport and export formalities.
FCA – COMITRONIC-BTI Factory, Canéjan (France): when COMITRONIC-BTI hands over the goods to a carrier appointed by COMITRONIC-BTI on behalf of the customer.

COMITRONIC-BTI provides only the commercial invoice
 for export customs formalities. All other procedures (declaration, transport, insurance, etc.) remain under the sole responsibility of the buyer.

Incoterm Clause – EXW Delivery

Unless expressly agreed otherwise between the parties, all sales are governed by the Incoterm EXW – COMITRONIC-BTI Factory, 14 Rue Pierre Paul de Riquet, 33610 Canéjan, France, in accordance with the Incoterms® 2020 published by the International Chamber of Commerce (ICC).Under this rule, delivery is deemed to have occurred, and risk is transferred to the buyer, once the goods are made available at the seller’s premises, without obligation to load the goods onto any collecting vehicle or to clear them for export. The buyer is responsible for all costs and formalities related to transportation, insurance, export and import customs procedures, as well as the delivery of the goods to their final destination.

Incoterm Clause – FCA Delivery

Unless otherwise expressly agreed between the parties, all international sales are governed by the Incoterm FCA – COMITRONIC-BTI Factory, 14 Rue Pierre Paul de Riquet, 33610 Canéjan, France, in accordance with Incoterms® 2020 published by the International Chamber of Commerce (ICC). Delivery is deemed to have occurred, and risk is transferred to the buyer, once the goods are handed over to the carrier appointed by COMITRONIC-BTI on behalf of the buyer. COMITRONIC-BTI shall provide the commercial invoice only for export customs formalities. The buyer shall bear all costs related to transportation, insurance, import customs clearance, and delivery to the final destination. Exports outside the European Union are VAT-exempt under Article 262 I of the French General Tax Code, subject to the availability of export evidence as required by the French tax administration.

PAYMENT TERM

Payments can be made via bank transfer, credit card (VISA, MASTERCARD), Stripe (+4% fee), or PayPal (+5% fee at your charge). Bank checks and bills of exchange have not been accepted since January 1, 2017. Online credit card payments are secured via SSL certificate. No banking data is stored on our servers; all your data is transmitted only to the respective banking institution (Crédit Mutuel, CIC, Stripe, or PayPal) or your own bank.

DELIVERY TIME

The delivery time has an indicative value and could not be a reason for any order cancellation or any com-pensation.

ORDER PROCESSING

Orders sent by email or mail are processed within 1 to 5 business days, depending on the period.
Orders placed online and paid on the same day are processed within 1 to 3 business days, whereas orders subject to conditions are processed within 1 to 5 business days. Orders are processed from Tuesday to Thursday only (business days).
Important:
• Orders sent via email must be addressed exclusively to order@comitronic-bti.me.
• Orders sent to any other email address will not be processed.
• Duplicate orders will be considered as separate orders and must be paid for accordingly.
• Failure to pay for an order will result in a mandatory upfront payment for future orders.

COMPLAINT, WARRANTY

Claims regarding delivered quantities must be submitted in writing by email to COMITRONIC-BTI within a maximum of 48 business hours following receipt of the goods. With regard to product quality, our liability is strictly limited to the repair or replacement, ex-works, of parts we have acknowledged as defective, provided they are returned to us within one year from the date of shipment, unless otherwise specified. The warranty excludes damage resulting from normal wear and tear, improper use, or lack of maintenance. No returns will be accepted after the warranty period has expired. Return shipping costs—whether the product is under warranty or not—are fully borne by the customer. We do not provide prepaid shipping labels under any circumstances; all return shipping fees remain the customer’s responsibility. All our products are covered by a 3-year warranty starting from the date of order receipt. For stainless steel sensors, the warranty is extended to 5 years.

RETURN OF GOODS

No returns will be accepted without our prior written agreement, even in the event of a commercial dispute or disagreement regarding product conformity.
If a return is requested due to a client error and is accepted, the following restocking fees will apply:
• 35% deduction on security products.
• 25% deduction on all automation products.

These deductions cover testing, restocking, and ISO9001:2015 traceability costs.
Returned products must be in their original packaging, unused, and unassembled. Special order products cannot be returned.

SALES CONDITIONS

The features, photos, dimensions, and weights mentioned in our catalogs are subject to change without notice by the manufacturer. The provided schematics, risk analyses, and application guidelines are for reference only.
The choice and purchase of catalog products are entirely the responsibility of the client. COMITRONIC-BTI and its partners cannot be held responsible for product selection or implementation.
Given the significant number of ongoing standardization projects and their evolutions, product risk categories may change without prior notice.
COMITRONIC BTI reserves the right to modify technical specifications without notice. These modifications aim to improve product performance, safety, and compliance with applicable standards. It is recommended to regularly consult the updated technical documentation to obtain the latest information.

In the event of late payment, penalties will be applied at the legal interest rate increased by 10 percentage points, along with a fixed compensation of €80 for debt recovery costs. COMITRONIC-BTI reserves the right to require full upfront payment for any new order in the event of a previous payment incident.

PRICES AND PAYMENT TERMS

All prices are exclusive of VAT. Shipping and packaging costs are additional or prepaid. In the latter case, COMITRONIC-BTI will invoice the buyer for shipping costs. Invoices are issued at the current rate at the time of delivery.

OWNERSHIP RESERVATION CLAUSE

COMITRONIC-BTI retains full ownership of the delivered goods until full payment is received. The goods may not be resold without COMITRONIC-BTI’s consent.
Until full payment is made, the delivered goods will be considered consigned and the buyer assumes all risks associated with them. In the event of non-payment, COMITRONIC-BTI may demand the return of goods at the buyer’s expense via registered letter until full contractual obligations are met.

DISPUTES

In the event of a dispute, the Commercial Court of Bobigny (France) shall have exclusive jurisdiction and is mutually accepted by both parties.

RECYCLING

In compliance with Article R543-174 of the French Environmental Code, all electrical and electronic equipment must adhere to this regulation. COMITRONIC-BTI automatically transfers the end-of-life management of products to the professional user.

PERSONAL DATA

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, query, oppose, and rectify any personal data held by COMITRONIC-BTI.
These data may be used for commercial purposes by COMITRONIC-BTI and shared with commercial partners. Clients may opt-out at any time at no cost, except for any transmission costs incurred to notify the service in charge.

TERRITORIALITY

These General Terms and Conditions of Sale apply to mainland France, Corsica, and French Overseas Territories (DOM-TOM).
For international sales, please refer to the “EXPORT SALES CONDITIONS”, available upon request.
By placing an order via internet, mail, fax, or phone, the buyer expressly accepts these terms and conditions.
